DMOC Partners Scott S. Centrella and Jonathan J. Kelson recently obtained a favorable summary judgment ruling on an issue of first impression relating to immunity for telecommunications providers under Connecticut’s Emergency Telecommunications statutes.

The plaintiff sued DMOC’s client, AT&T Corp., and another provider, alleging that she was harmed by a disruption in Connecticut’s 9-1-1 system. On a motion for summary judgment, DMOC argued that the applicable statute provided broad immunity from liability for any failure of equipment or procedure in connection with the 9-1-1 system. After noting the lack of case law interpreting or applying the statute, the Connecticut Superior Court agreed with DMOC’s analysis of the facts and legal issues, holding that DMOC’s client is immune from liability as a matter of law.
